April 2, 2020 the US Treasury posted on their website an “Interim Final Rule” (attached) announcing the implementation of Sections 1102 (the program) and 1106 (Forgiveness) of the Paycheck Protection Program. While not final, this gives us more guidance as to how they are thinking.

Here are the highlights:

  •  Household employers not eligible (not considered a business)

  • If a more than 20% owner is a felon, cannot get a loan

  • Independent contractors DO NOT count as employees for either determining how much loan can be obtained or how much can be forgiven because they can apply on their own.

  •  Interest changed to 1.0%, still a good rate

  • Still a 2 year maturity

  •  Loans are first come, first serve!!!

  • 6 month deferral until payments begin

  •  More guidance coming on loan forgiveness
